Sony to make it illegal to sell second hand PS3 games

At the start of the year Sony filed a patent that could threaten the second hand games market and independent retailers alike.

The patent would allow Sony to lock a game to the first console that it was played on, meaning that if you sold the game or lent it to a friend they would be unable to play it on their console.

Sony stated at the time that the aim is to protect itself from counterfeit software, but were aware that the same technology would also prevent the re-sale of used games.

At the time many people shrugged it off not really thinking Sony would go through with the idea as it would kill the second hand games market, the games rental market and seriously hurt independent retailers. All of which could damage PS3 console and games sales.

However retail sources have revealed to GamesRadar that "high street games shops have been told by Sony that there will be no PS3 pre-owned sections in their stores as it will be illegal for customers to sell any next-gen PlayStation games that they've bought"

It seems that Sony intend to do this by adopting a licensing scheme which means that gamers won't actually own their games, instead they will merely be purchasing a licence to play them.

Will Sony use their patent? Will Sony make it illegal to re-sell PS3 games?

At the moment no-one really knows, but lets hope not.

Sony have yet to comment on the rumours that they will make it illegal to re-sell PS3 games.

Late 2005 Sony debunked the first round of rumours about locking games to a console by saying "this is false speculation and that PlayStation 3 software will not be copy protected to a single machine but will be playable on any PlayStation 3 console."

We posted this news story due to re-speculation of the patent and rumours of Sony licensing games.

We have contacted Sony regarding both rumours / speculation, and it seems (as most thought) that they are both 100% false, we are just waiting for 100%. concrete confirmation from Sony Europe.

I don't think they will do either to be honest, why would they when it would only harm PS3 sales. Maybe its just a publicity stunt, albeit a lame one ;)

People spread these rumors because the purchased a xbox 360 in the last 6 months and wished they had waited for a PS3, so they are going to try to get other people to think that Sony is doing all these bad things so they can justify their purchase and make other try to follow them. Boy this sound sound like people who said that mac was crap and you should buy a Microsoft Windows system and look how many people are now starting to switch to Macintosh now that they found out what Microsoft is really about and how they fooled a lot of customers. Learn a lesson now!! Do not fall for Microsoft saying there system is the greatest and other are bad, they want you to get there system so they can screw you all over again.......

I am not sure if its people with xboxs as you say, esp when you consider that Sony did actually file the patent technology to stop people sharing their games and selling them on after. Also the news is being published mainly by news sites that have no alliance with either Microsoft or Sony (i.e us). Sony could even be happy with the press, after all they are getting plenty of column inches and the more people talk about the PS3 the better (in Sonys eyes). What the old saying "any publicity is good publicity"? :)

I dont think this is a scam because i found articles all over the web about this .If sony does that it kills every chance of buying the cosole .Get a 360 +wii combo !

Its a tough call as the Playstation has a very strong following. The move would put of the casual gamer, but you will probably find hardcore PS fans will buy the console regardless. Maybe the next poll should be, would you buy a PS3 if they did make it illegal to re-sell games (or if they locked games to the console if was first played on)

I must admit i was / am very sceptical of the news making it illegal to re-sell games. Which is why we tried to post an opjective story, stating what was true, what was a rumour, and what we thought. Not only does it make little business sense but it would be a logistical nightmare to enforce the idea of stoping people re-selling games. The patent to lock games to consoles, although i am sceptical of this technology. It has been proven that Sony did register the patent, but do i see them ever using it? No, because again although its easier to implement it, it makes very little business sense to do so.

So... when your ps3 breaks and you have to replace it, you can re-buy all of your games. Or, go through some type of "migration" program to re-liscense all your games to your replacement console with Sony's intelligent customer service reps. That's awesome.

People trade-in to buy new games. Removing the ability to trade-in with affect the purchasing of new games as people will have to pay more. Therefore, there is no way this will happen. Besides which, what happens if you have two PS3's in the house?

GameRadar is a 3rd class website that is only trying to gain popularity by confusing people into thinking Sony is that stupid. Why is everyone getting so desperate? I.T vibes job is to post unbiased news and we post it as and when we find it. Sometimes the sources turn out to be less reliable than expected. We spoke with Jennie Kong the UK PR Manager for Sony Computer Entertainment Europe today and she did indeed confirm that the rumours were false. I hope this helps clear up any confusion.
