Microsoft sued over Xbox 360 problems

One of the most anticipated hardware devices of the year, Microsoft's Xbox 360, appears to have a few issues when it comes to heat. The power brick that powers the gaming console has been reported by users to overheat, causing the machine to freeze when in use.

In the original Xbox the power supply was integrated into the unit. The new system however has an external power supply, much like that of a laptop. However the Xbox 360 has fairly strenuous power requirements and the power supply is pretty big to cope with the demand. Naturally heat is produced from this supply, but in some cases it seems that it isn't being dissipated quickly enough.

Microsoft is claiming that the issues only affect a tiny fraction of the consoles they have shipped, less than 1%. However, a Chicago man disagrees, and is taking Microsoft to court with a class action that claims that the product was rushed to market and is defective.

We don't expect that this class action will get very far, Microsoft has plenty of money to throw at problems like this, and Microsoft execs are no doubt more concerned about how to produce more of the console that has pretty much sold out in every region it's launched in so far than little problems like too much heat. We'll let you know how the case progresses.

Such biased weighting put on just a few users reported problems. Since when does one person taking MS to court on frivolous (i mean if it was a design defect you would expect more than a handful of complaints) charges constitute real news?

Why is that when a hot item is coming out around Xmas that the manufacture never meets supply and demand. It seem to many of us who are frustrate consumers and very desappointied in how it is handled. Even if you pay to reserve the item to insure that u get when it comes out, the stores are only shipped 20 each. We realize this the way it will always be and more so disappointed that you can not purchase the Xbox 360 or see it in stores til after the first of the year. If your are going to bring a new product io the consumer you should have your supply better marketed. is

It is typical of the crazy, litigious americans. The guy just wants MS to settle out of court so he makes a wadge of cash. It's pathetic. The comments in other posts about supply and demnd are spot on. I'm trying to buy a Nintendo DS here in the UK and can't even source one on eBay with a £50 premium !

im 13 years old and if i ONLY got an xbox 360 this year for xmas i would be perfectly happy. if it didnt work i would be pissed but i dont think i would sue someone. i would whipp out my warranty card and call microsoft and get another one and wait for another one to come. my friend recently got an xbox(original) and i got into halo. after we got into the game i decided that i wasnt going to wait for the ps3 to come. i was too late to reserve one but i was hoping that i could get enough money for xmas that i could get one when on the next shipment. it annoys me that microsoft in their rush to get it out before xmas did not make enough to meet the demand of the highly excited customers. im surprised that they could not think of something with their people who are paid to give ideas about what to do to make a larger ammount of people happy. a lot of my friends did have reservations and did get their systems and they are fine. that guy had no right to sue microsoft because his system didnt work. he needs to get over it and get another one with his warranty. im sure that if he doesnt get another xbox soon he wont die. he needs to stop whining like a little b**h.

When it comes to reservations its true that no matter how much u pay for the reserve, the chances of the person reserving still has a good chance of getting canceled. My friend tried twice once paid 1 grand and the 2nd tried 2 grand. Finally, he just said F*** it and went on ebay to buy one for a grand. So if people are tired of waiting I believe Ebay would be the best way to go.

To let all of you know who are blasting the Chicago man for suing is that I was first in line at my local store for over 17 hours! Got my 13 yr. old the Premium 360 for Christmas. Started hearing about all the problems and let him play it to make sure it worked. Well it didn't. I had 3 blinking red lights on the console. We returned it for repair. Got the repaired one back and the darned thing STILL DIDN'T WORK. Same error with System. I was a little ticked when I called customer service. I wanted a new one this time instead of a repaired one and they told me that if I'm in the United States, I can only get a repaired one. Go figure that one. I'm currently waiting for the 3rd one to arrive so I can check it out and if it doesn't work this time, I will certainly file a lawsuit myself. I'm very upset with Microsoft for rushing the sale of this supposedly great system before it was ready to be sold!

I'm glad the 360 is defective, it serves Microsoft right. Stupid, greedy bastards... I hope the whole thing blows up in their face and they go bankrupt and Bill Gates jumps off a building. I reserved my xbox 6 months and got home with the thing and e74 pops up on start up. i just have to turn it on 3 times in order for it to work. I have the extended Warrantee ill just wait 3 months turn it in and get a new one, the microsoft warrantee has to expire first in order for the gamecrazzy to take effect. man this real kinda piss me off ,I Kinda dont trust microsoft now

Reserved mine from EB back in October, due to arrive Monday, and despite all the apparant articles and lawsuits, I doubt it'll have problems. MS might not be perfect at making games, if we all haven't forgotten about the free protection chords sent out to people who had old xbox's, but the number reported overheating in that case weren't very high either. Just seems everyone who has a 360 with problems is posting about it, and seems like a bigger problem than it is. Aside from that, the whole 'shortage' issue is just a marketing ploy used by basically every console launch (wander into gamestop or another store and ask a veteran employee to explain it to you), only advice is reserve real early or buy on ebay for a few hundred more. And in reply to 11, if Gates/MS went bankrupt, there sure would be a lot of poor charities missing out on billions in help in Gate's will.

I think they should roll out and make a newer version of the 360 with an HD-DVD drive and start make games in that format so there aren't games w/ 4 DVD's i have been waiting so long for the launch date and when it finally came out i am sceptical about getting one

we recerntly purchased an xb360 here in the uk, so far have been unable to get it to work for more than 10 mins it just keeps crashing, shop we bought from very frustrated at lack of appropriate response from microsoft, have tried in vain to get through to helpline number for over a week now, and we are now beginning to hear of other users locally who are experiencing problems, there are going to bea lot of badly dissappointed kids on christmas day, my son being one of them, was all the hype and hurry worth it?

I agree with #17, even before the 360 came out and all of the problems have been reported I had planned on waiting until next year to buy one. It's like any new high tech product whether it be consoles or cars there are always glitches in the first build. Granted I do think Microsoft should have spent some more time testing it but problems were bound to surface no matter what. I've had a original Xbox for a couple of years now and the DVD drive took a s**t last week. So, I think I'll just plunk down 30 bucks to replace the drive and wait a few months for the bugs to be worked out.

Microsoft should have done more testing on the stupid machine even if they don't get it out before christmas it doesn't matter ppl will still buy it and kids will just tell there parents that they don't want as much for christmas if they can get it later I mean come on think it through

i have had my xbox for three weeks and now it comes up with a flash of 3 red rings once cooled down it works again but i have eventually got through to microsoft who arranged to pick the console up via DHL and get me a replacement by Friday so i have one for xmas, but i am still waiting on DHL picking up my Xbox360 so i think i can stop holding my breath for my new one by xmas as it is apparantly coming from Germany HO HO HO merry xmas Microsoft

I reserved mine back in September and received it in time for Christmas. Opened on Christmas day, E74 by Boxing day. Also destroyed Perfect Dark by etching the disc. Microsoft say that the E74 error can be resolved by disconnecting everything for 5 minutes then reloading to the dashboard a music CD, burned CD then a game. Reconnect the harddrive, reboot, build a new profile then load the discs in the same order. Play thee game this time - if you get the same error then Microsoft will replace the console!!!!! Done all that - got the same error immediately. I'll let you know if they replace it. Strikes me they pushed it out for Christmas without full testing. Greed - nothing moe nothing less. We the minions will ultimatley have to pay. I wonder how many xbix 360's are actually affected - only time will tell!

microsoft hardware is always crap, just look at the mice they put out compared to logitech. I realy wanted a 360 but now I will wait. This pissses me off as I have bin a shareholder since 95 and rode it to the top only to see if do nothing for years. the original xbox was microsoft jumping the shark. It always lost moneyon every unit sold and never made it back on game sales.

I just got the new 360 and when ever I try to play madden 06 it freezes up. Has anybody come up with some way to cool this machine down? I love this thing, but what is the sense of having one if you can't play the high graphic games. That is the whole purpose of buying one of these systems, is for the graphics. Good luck Chicago.

i like the 360 alot. But sometimes mine just stops what it is doing and goes to a red ring of light. It kinda ticks my nerves but it is a great system. There is some problems with it though and they need to be fixed. I stood in line for hours and spent a good 400.oo on the thing and it really doesnt work right sometimes.

i was supposed to get 360 launch day i didnt i was mad i received mine from gamestop december 19.2005 i spent 4400 dollars on it two weeks later (January 9,2005) i turned it on and i seen three red lights i called up microsoft and they sed it was an internal problem from overheating i havent played it in a day and i just turned it on. I thinks its bull **** that microsoft seys only 3% are defected its all i lie and u people dont have to believe but everyones is gonna break and microsoft sed they well fix mine for free so i sent it out and they sed they neva got my system so i have to wait until it comes out again. Well we al no how Microsoft has money they rip people off if they wated t rush it out y didnt they atlest have a good system i mean tha gameconsole with garphics and everything good im talkin about tha **** inside of it they have anough money to fix it but no they just ripped about 4 million people off from 400 dollars eachh so do tha math 4 million time 400 dollars its alot AND BELIEVE ME PEOPLE ITS GONNA HAPPEN TO U ITS GONNA BREAK SO BE PREPARED

I bought a 360 on launch day only to have it freeze on xbox live every time I went online. I called microsoft and in about a week I had a new 360 at my door. It was refurbished and worked for about 2 days and all of the sudden it wouldn't read the disks. It was reading the games like dvd's saying please insert this disk into an xbox 360. I had to send that one in as well. Microsoft recieved it on the 27th of December and it is Jan.12th and I still don't have it back. I've called about 7 times and have been told numerous things. One guy said I would have it back friday so of course I didn't and I called. The lady said her supervisor would contact me monday, witch never happened so I call them and they said call back thursday for an update. I called thursday and the told me to wait another three days for someone to call me. I have been lied to several times by these people and i'm wondering if anyone knows what to do about this at all.

My friend had his 360 since a few days or weeks after release. We played several different games for hours and hours and I never seen him have problems with it and asked and he said he hadent. It does get warm but it doesnt have the problems people talk about. I would have and will buy one but I am waiting for Oblivion.

hi i think that xbox 360 was under rated cause ms did not say everything it was going to do i give it 1,000 out of 1,000 the games are kool more of quake 4 but i think that doom 3 roe was not good cause the pc version had ctf so i know that it could be that xbox could not handle it say lets try 2 get it in xbox 360 ok cause then i will be buying more games of fps

we bought a 360 today and my husband played it for 30 min and it went off. I mean nothing but a red light on the power cord was on. The game is stuck in it. We called customer service and the lady said it was broke and to take it back. She said we could call back later if we wanted. Why? I don't know since the game wouldn't come out and the system wouldn't turn on. We are very disappointed. Going to take it back in the morning and get our money back. I hope!!!!!!

i bought my 360(London UK) from Game around march, 2days later i needed to replace it because of flashing red lights. Game are cool and replaced the machine right away. London had the hottest summer on record this year and i had no problems until september when the flashing lights reappeared. Again were great and replaced the machine again. It is now the end of October and yet again the flashing red lights have returned together with crash symptons. I will replace it again but as soon as the ps3 date gets closer, the box is history. I could not keep this machine out of its year warranty period it simply is too risky considering the numbers of people that have issues aswell.

Just bought my son an XBox 360-spent over $600 and it worked one day. In my opinion, this was the most stupid purchase I have ever made...I would not have made it after talking to the Best Buy employee- but thank goodness did take out the replacement warranty. Just wondering if Sony would like to pay for my gas to run back and forth 30 miles away to keep replacing if this dumb thing doesn't work. What a way to throw away hard-earned money!!
