iTunes UK owner to appeal at high court

The 22 year old owner of the iTunes.co.uk domain name, Benjamin Cohen, has applied to the UK's high court for a judicial review of a dispute which is occurring over the iTunes.co.uk domain name.

It was at the end of last year that we reported on how Apple and Cohen were locked in a cyber-squatting legal battle, and it would appear that Nominet has since ruled in Apple's favour, requiring Cohen to hand over the domain name to Apple. However, he is not willing to do this without a fight, hence the application to the high court.

Benjamin Cohen first registered the iTunes.co.uk domain name in November 2000, and it currently forwards to the QuickQuid web site, also owned by Benjamin Cohen. Apple did not trademark the iTunes name until December 2000, and even then it was not for music products.

It will be interesting to see how the high court rules in this one, and as always, we'll keep you posted.
