Update on RIM BlackBerry patent case
Wednesday, December 15, 2004 at 20:00 by Rich Kavanagh
You may recall the case we reported on back in June where patent holding firm NTP filed an infringement lawsuit against BlackBerry manufacturers Research In Motion (RIM), seeking $53 million in damages.

RIM provided an update yesterday, following receipt of a ruling from the United States Court of Appeals for the Federal Circuit in regard to the NTP Inc. vs. RIM litigation.

In response to RIM's appeal of a judgment of the U.S. District Court, the United States Court of Appeals decided that RIM infringed on 11 of 16 patents and ordered the judgment vacated and the case remanded to the District Court for further proceedings. The Court of Appeals also ordered the injunction (previously imposed and stayed by the District Court) vacated.

The U.S. Patent and Trademark Office ordered re-examinations of all NTP patents litigated in this matter. These re-examinations continue and are separate and unaffected by yesterday's ruling.

Further comment and details were not disclosed.
