The DVD Copy Control Association (DVD CCA) has filed a patent infringement lawsuit against the creators of the popular DVD backup programs DVD Copy and DVD X Copy, 321 Studios.
Following on from dropping it's case against individuals such as Andrew Bunner for distributing software which was able to defeat the DVD CSS encryption, it seems that the DVD CCA is now intent on targeting organisations who provide software which is capable of defeating DVD copy protection.
Steven Reiss, an attorney for the DVD CCA had the following to say:
"In taking this legal action, DVD CCA is turning its focus toward those who produce and broadly distribute products in the marketplace that facilitate the widespread infringement of the copyrights on motion pictures that CSS was designed to protect."
The key point about the software is that it is able to get around the DVD's copy protection software, which according to the DVD CCA encourages piracy and copyright infringement. 321 Studios are also being sued by Macromedia who claim that the DVD X Copy family of products infringes Macromedia's patented copy protection, as well as violating the Digital Millenium Copyright Act.
It will be interesting to see how this case develops, given the failure of the case against DVD Jon, creator of the DeCSS program which did essentially the same thing, and the widespread dropping of cases against individuals hosting the aforementioned DeCSS program.
